Jim Bates - Expert Witness Who Took Chief Constable Colin Port To The High Court

Bates now claims that he is “aware (and will prove) that those images had been “exhaustively” examined (unlawfully) by Avon and Somerset police in September 2008 and were identified as being within active and archived case”. Therefore, he goes on, Mr Port has either been “seriously misled by his own officers”, or presented a misleading and “emotive story for public consumption”.

Last September, police obtained a warrant and raided Mr Bates' home, but the High Court deemed the warrant to be "unlawful" because much of the material seized attracted legal privilege or was confidential. But crucially, when the order was made on May 8 to return the material, no deadline was set.
So yesterday, Lord Justice Stanley Burnton, sitting with Mr Justice Wilkie and Mr Justice Calvert Smith at London's High Court, dismissed the allegations that Mr Port had breached the order and been in contempt of court. However, Lord Justice Burnton criticised the chief constable's behaviour.
"The chief constable had an obligation to comply," he said. "He did not do so. Instead, he gave an interview to The Sun that gave grounds that he might indeed not comply with the order. It's regrettable in a case involving a chief constable the matter has come this far but in my judgment this is not a case where there is an enforceable committal."

..........................that you refer to show children being sexually abused. They must be destroyed as soon as possible. Why should they be returned to this man?

He is no longer a police expert and therefore can't be working on any active case. What possible reason has he got for hanging onto them other than for his own gratification.

anyone listening to the interview can work out why he has the images. the high court agrees with him.

if i was mr ports parent i would send him to his room.... bad port...no pudding for you!

From what i have gathered the court case appears to be around whether or not the discs were legally seized by the police and not about the contents of them.

i still maintain that any discs with kiddie porn on them should be destroyed so that they never see the light of day again.
